I guess I'm alone in this. I've done some more digging and found this post http://www.jboss.org/index.html?module=bb&op=viewtopic&t=61675 and this bug http://jira.jboss.com/jira/browse/JBAS-1600 which says it has been fixed in 4.0.2. I haven't checked to see what the behavior is now in 4.0.2, but I'm hoping that if a CreateException is thrown from ejbCreate, the behavior of the client proxy will be to fail-over.
I will look into 4.0.2 and see what happens. Hopefully, I can back port this fix to 3.2.6.
