Schwab was aware of Web access problems earlier. Its solution was to
provide broker assisted trades at the same price of Internet trades
rather than commit to an overall plan of WCAG accessibility. The
company was informed of other problems when it was presented with the
ultimatum to enter into structured negotiations with plaintiff’s
attorneys that the company would eventually compensate or resolve the
issues through a class action lawsuit in the California courts. The
company was cooperative only to avoid the high damage awards for
disability discrimination in California. Thank goodness the company
has changed its practices in the long term and has embraced
accessibility. By contrast, Fidelity has made its site fully
accessible without lawyers or the threat of a lawsuit.
