Via RemoteControl, can we create a new osm data layer, but not
download any osm data? We expect the person doing the validation to
download the data they need manually, but we do want to set them up
with a blank, empty osm data layer for that purpose.

The reason we want to do that is because we are passing in geometry of
the area that needs to be validated, but we want to put that data on
its own data layer with upload=never, then create a 2nd data layer
that is empty for them to download osm data to for validation.

Is this possible in some way?

It should be possible using the "import" command. (Create an empty layer, save as "empty.osm" and make that file available for download on your website.)
