this is not necessarily true.

name attributes must be unique when they are used as a unique identifier for the following elements: a, applet, form, frame, iframe, img, map -- just like IDs.

But, they don't have to be unique when used as a parameter key for the param element or when they're used for form controls such as input, button, and select.
