loading bcm2835-v4l2 causes kernel oops with 4.4 kernel

Bug description:
attaching a raspberry pi camera to the pi camera interface (CSI) works
fine when capturing video, pictures and streams directly through the
picamera python library.
when trying to use software that relies on using /dev/videoX with a
camera attached to the CSI interface, the bcm2835-v4l2 module needs to
be loaded. loading this module results in an oops like:
