kernel symlink creation fails, prevents kernel upgrade

Bug description:
Starting with linux-image-3.2.0-38-generic I cannot upgrade the
kernel. The reason is that if symlink creation fails then now it is a
hard error. It was a warning before. Honestly, is the failure to link
vmlinuz to vmlinuz.old worth aborting the installation process??
