Joe painted the painting. No one told him to paint the painting. No one commisioned or paid Joe to paint the painting, nor was Joe "on the clock" for anyone else during the hours he painted the painting. Joe had never, in his life, signed or othewise explicitly agreed to any arrangment concerning his painting. Joe never transfered the copyright to anyone. Joe never gave away the painting, nor used it in a barter. Joe painted it in his house, which he owned free and clear.
