Hold on before you get out the party favors. This case is far from over. There are several issues still on the table, and it only takes one to survive discovery (which, BTW, is not really over yet) and any PSJ motions to force a jury trial.

Most likely, unless IBM and Novell can show TSCOG has no standing, this case will go to trial sometime in 2007. That will probably be a contract case if IBM is successful in an expected refiling of a motion for PSJ later this year, regarding Linux containing infringing code.

Don't rely on what some reporter says about the status of this case. Or even a lawyer who hasn't researched it. Look to the courts for the facts. You can find most of them, as well as other things like time lines, court documents, and informed expert legal opinions on Groklaw and on the Yahoo! financial SCOX board.
