This deal means nothing to anyone but Microsoft. It is not a covenant between Microsoft and Novell, it is a covenant between Microsoft and Novell's non-commercial customers (especially developers) and between Novell and Microsoft's customers. In other words, both companies made deals on _our_ behalf, that as long as we don't make money from FOSS software, they won't sue us for the next five years.

As this (http://www.softwarefreedom.org/news/20061109a.html) article points out, this deal is worse than no deal.

As far as Novell is concerned, they are now deader to me than Microsoft (whom I already knew to be a snake).

As for Mono, I'd say there is even more reason to stay away from it, or anything using it if you are a developer. Note that neither M$ nor Novell explicitly say if there is or is not any of their respective IP in the other's products. So we have no way of knowing whether this is mafia style racketeering or merely huff-puffery.

If I were still a developer, I would not even set eyes on any Mono code. Too much chance that M$ has now decided that since their proxy SCOX has failed, it's time to do the job themselves, with targets being anyone who has touched their precious with any of their five senses.
