I found this info (below),. Still a little hazy but this helped.

An aircraft such as the KR which was certified without engine driven
electric (alternator etc) is exempt from having ADS-B out (still of
course optional). As far as I can tell, the impact on airspace is at
issue. Can get pre-authorization 1 hour before up to 24 hours before.
Also, if while flying, ATC directs you into ADS-B required space and
you advised them your non-ADS-B status, thats ok too. The mode C veil
part is a little confusing however. Class E above 10,000 except up to
2500 AGL, so can go above 10,000 for terrain with no ADS-B too.
