Research would indicate the designer sets a speed , Vd, (velocity dive), the aircraft is tested to that speed to insure no vibration or flutter, and then Vne is set at 10% below that number as a safety margin.  Lots of variables there in testing like was the air calm or turbulent, aircraft weight, were the controls "bumped" to test for flutter, etc.

We would probably be amazed how many times we fly on the edge of disaster without knowing it.
