The Public Safety Committee will be holding a hearing of
Council Member Dennis Zines motion to amend Special Order 40. Special Order
40 is a policy that prohibits officers from inquiring about legal status.
This rule was created in an effort to encourage victims and witnesses of crimes
to come forward to report the crimes without fear of deportation. Due to an
unfortunate incident in which Jamiel Shaw Jr. was allegedly shot by an
undocumented gang member, anti-immigrant groups have used this case to push
their agenda and divide the African American and Latino community.
On April 11, 2008 Councilman Zine introduced a motion to Los Angeles
City Council in which the LAPDs Special Order 40 would have one exception.
Zines version would allow LAPD to inquire as to the legal status of known
gang members and then report them to ICE. This would require LAPD and ICE to
work together to enforce federal immigration laws and based on subjective
gang identification.
A couple of months ago at the Board of Supervisors meeting
immigrant rights advocates were outnumbered in the testimonies to keep local
law enforcement and immigration enforcement separate. Please make sure to
attend this hearing and show support for Special Order 40. It is imperative
that we stop Zines motion from moving forward in the Los Angeles City Council.
If this ordinance passes it will jeopardize the safety of Los Angeles because
victims and witnesses will fear coming forward to report crimes for fear of
being deported.
