Assuming you can see my argument but think its a bit dodgy:

Doesn’t matter what it smells like, my point is that HMRC won't necessarily
find anything.

If you can't see my argument:

If you were a sought after artist and I wanted a painting by you, but you
weren’t free for 2 years, I could sign a contract with you now where I agree
to pay you £50k for a peice you'd do for me then.  As you would be turning
down other work for then you could reasonably say that if for any reason I
cancelled the contract I would still have to pay you the full amount.  It's
then my choice whether I agree to those terms or not.

If I agree, no money has changed hands now but I have a commitment to you in
2 years time for £50k.  I (will) owe you £50k whether you do the work or
not.  You would not have to declare that work commitment anywhere with
regards to your accounts this year.
