My point is Rick that the FL could argue that they couldn't possibly decide whether the sale constituted an exceptional circumstance until such time as the sale happened. In other words the pearson bid wanted their decision before the process had finished. Did Redbus not know this, after all they risked winning the bid only to not have the GS granted? AFAIK the exceptional circumstance is invoked should a club not complete the CVA. Are there extra conditions attached to the exceptional clause? Conditions Bates knew about? I thought half the problem here is that the exceptional clause has never been invoked before, therefore there are no clauses/parameters/precidents. That leads to potential (political) problems down the line for the FL cos if they let LUFC do it, they might have to do the same for other clubs and therefore the CVA requirement is circumvented, and with it the 'fair play' element of that they are relying on the protect their preferential status? > > Think it through.
