What are the football debts (how much do we owe)? I don't understand why the FL are insisting on the completed CVA if that is going to be the test case that makes them lose preferential status? I would have thought they would rather use the 'exceptional' clause than do that. I also have a comment on the 'further punishment' line if FL go down that route - we have already been punished for going into administration, and it is not LUFC fault that the football didn't get paid, it is HMRC (on the assumption that the Astor issue is resolved and I'm sure that's not outside talents of Bates' team to sort out). Having said that, I have an 'out' for LUFC/FL, and future CVAs. Football stands in line with other creditors, to remain in the FL after a CVA there must be further sanctions in line with the unpaid debts to football. That sanction is a fine equal to the amounts still outstanding. The FL then compensates those in football who are owed, conveniently the full amount they are owed. Effectively all football debts are actually paid. It is none of HMRC (or any other creditors) business what conditions another creditor places on LUFC to continue doing business. It is no different to the police insisting that they get paid up front for future match day policing, or Bobs disco to refuse to deal with LUFC.
