It could also be that TNG 10 is mistranslating some other tag to Private on import, particularly since at least one of the persons indicates he has no private tags in his Legacy Gedcom. Whether that is the case or not I do not know, as I haven’t yet had time to move to TNG 10 yet. I’m using the most recent build of Legacy, and do not see this happening in TNG 9.2.2

This has to be a Legacy problem. The data to be included (or not) in the Gedcom is selected by Legacy on the basis of its privacy settings. If private data is getting through then Legacy is not honoring its own settings. You would not expect any privacy tags in the Gedcom.
