I have always thought that the LGPL and GPL can be contested by someone other than the licensor, i.e. that EntityA can contest in court whether EntityB complies with EntityC's LGPL license, and the rationale would be that "Joe Hacker" would never be able to challenge, let's say, SCO in court, but for instance IBM could. Adding to this swamp, is then that ultimately it doesn't matter what anyone says, except the Judge, where ever it is presented to the court. Personally, I also believe that ASF has no real effect in protecting the user from a predatory company. The best that ASF has done so far is to provide a large set of people with a 'known playing field', which seems safe enough to play on. IF ASF decides to allow Hibernate and other willing LPGLd projects into ALv2 projects, *I* would like to see a big stamp on each of those project's front page, indicating that LGPLd code is linked in. In respect to Hibernate, the situation is already 'strained', since the SpringFramework already uses Hibernate, and distribute the derivative work under ALv2. The Cocoon project investigated to use Spring, and could unknowingly added Hibernate link to the ASF codebase. In the case of Hibernate, I wouldn't take their word for it either. They play intimate ball games with JBoss, and Marc has in my view lost any and all respect, and who shouldn't be trusted. And apparently the Geronimo project was born out of "tension" between Marc and some developers, I wouldn't be certain that he doesn't look for ways to get back at ASF (esp if Geronimo starts cutting into his market share). So, from my perspective, only 2 scenarios would satisfy me, to distribute ASF code "linked" to Hibernate; 1. FSF makes an amendment to the LGPL where FSF outlines how a compatible linking can be made, which Hibernate accepts as their new license. 2. Hibernate changes its license to one of the ASF accepted ones, preferably ALv2 :o) My two cents.
