Most projects assume, for better or worse, that they have an implied
trademark.  Avalon was quite peeved when Microsoft co-opted the name for
their name for the next generation graphics engine, but decided that there
was nothing that they could do about it.

Even a registered trademark is not always a help.  We own the federally
registered trademark of DevTech.  We are the sole entity legally entitled to
use it in the domain of computer software and services (there is another one
in the economic development domain).  We have successfully caused some
companies to change their name, but we still have trouble prosecuting it.

Just this morning, I came across a company called Avalon Inc., and one of
their products is (drum roll, please): Avalon Axis
(http://www.avaloninc.com/).  So which is our trademark?  Axis or Apache
Axis?  And if the latter, do we need trademark protection for the part that
isn't "Apache"?
