When you constrain at the end of assembling each element.

I was wondering if there was some LBB stability criteria that an
adaptive mesh might be breaking... but I used to use Q2/Q1 Taylor Hood
elements on adapted grids all the time without running into issues
that affected my dumb GMRES+ILU solver options.
