Trying to play Devil's advocate here. There are a number of countries that censor Internet traffic and have laws which are repressive. Let's say someone from China listens to a song criticizing the the Chineses leader (or substitute North Korea for China), or someone from a Muslim country listens to a song which parodies Mohammed/Allah, or someone from Turkey listens to a song which has a message about the Armenian Genocide? These people could be flogged or killed for doing so. Scrobbling isn't without potential penalties in those situations (fabricated as they are).
