If C5 contains a validity list with 1,2,3 and is set to 1, I can AF down to C9 that now still contains a validity of 1,2,3 but the shown value of 5, which is not accepted. So either we block AF for validity or modify and copy rather than continuing a series. Excel just copies the content by default (fill series: linear) but can also grow when the ctrl modifier key is pressed. And then it happens to result in the very same issue of content with wrong validity.
