Yes, it is legal. It's a legal modulation type (G1B/D or J2D, depending on
how technical you want to get) uses an authorized code (ASCII) and uses a
documented coding technique (varicode) in accordance with 97.309(a)(4).

I'd certainly prefer that open protocols be used. The way to achieve that is
to 1) devise or adapt such protocols, 2) implement them on a variety of
platforms and 3) get widespread acceptance of them. That's what the PSK31
developers are doing for a slow-speed, keyboard-to-keyboard protocol.
