The fact that Nvidia and ATI get away with it?

The choose to take a risk based upon a specific interpretation of the boundary of a derivative work. Since the boundary is untested in law its not certain who is right.

Plus the fact, that if somebody sues them, they just remove the drivers from their list. Linux is so small for them, that probably don't care (plus there is an open source nv & ati driver).
