This all goes back to marketing FUD from USR. The X2 standard
could not go faster than 53kbps without breaking FCC signal level
restrictions due to *X2*. There is not and never was a restriction on
the actual data rate.
56KFlex and V.90 did/do not suffer from this. The entire "FCC
restriction" was a USR marketing thing to explain why there 56K modems
could not do 56K
