It is broken already then IMHO 8).

RFC1122 is a sore point with a lot of people. Real blood was spilt over tcp
keepalives. The whole concept should never have been allowed to get into the
protocol.
I've benchmarked your patch - you seem to be right. I can't measure performance
differences above the noise level between the patched and unpatched kernel.
