If it happens in newer 2.1.x kernels, it's a driver bug. There is no
question about that - the 2.1.x kernels do interrupt handling correctly
and cannot re-enter.

There have certainly been a lot of driver bugs: later 2.1.x kernels have
what appears to be correct fixes for the eepro100 and for a 3c509 card.
