It's true that the first hunk of the patch won't apply cleanly to 2.6.9, but that shouldn't matter since that part of the patch is present only to prevent a compiler warning. The second hunk is the important one, and it applies cleanly to 2.6.9. You say your kernel has oopsed? But the message you sent in before was not an oops; it was just a "Badness" warning. The disassembled code you attached looked almost exactly the same as the code you sent before, as though the patch had not been applied at all. Are you sure you disassembled the patched version of the driver?
