A delayed CTRL in solved the problem and I am able to run the driver now
from an application and have an acceptable solution on SuSE 9.3

I suppose a thorough analysis of running processes could lead to
discovering where the problem is. For the time being I need to move on
and will settle for the status quo.

Thanks again for the valuable pointers.
