They can still hand out some piece of code to you, show you that their hardware works but force you not to make it public, can't they? Not that this makes any sense at all, but I've seen many companies doing such nasty stuff. And if this is the case with the ISP176x driver written by Philips, that would be reason enough to re-implement it with a proper licencing.
