reboot?

Some processes are designed to restart after a kill, often the way to
tell is after you kill them they re-appear with a new PID.

For example this line in inittab respawns (or restarts) the getty on
console 1 at runlevels 2, 3, 4 & 5. If you kill it, it will restart. 

1:2345:respawn:/sbin/mingetty tty1

You can also start other persistent services here if you want. One I
have seen is pptpd (pptp VPN server).

Also some processes are called on demand by [x]inetd.

SO, before assuming kill isn't working, check the program is not being
restarted by another process.
