True. But -- and it's a big but -- Topica got permission from the
steward of PAML to use the material. which implies that the person in
charge evaluated the situation and approved it (in fact, I know
Stephanie did do that, and asked a lot of not-easy questions...).
So, if you trust PAML to list your list, and PAML trusts Topica to
use the PAML list, are you saying PAML didn't have the authority to
do so?
I could argue that both ways, myself. Frankly, given that PAML is
posted to USENET every few weeks, talking about controlling the
content is silly -- sites just grab and use it willy-nilly, and we
all know that and have had to deal with the side effects. But
shouldn't topica get some brownie points for not using the lists
without getting the usage blessed in advance by the steward?
I think Topica did the right thing here. They asked. If they were
told no, they didn't do it. If they were told yes, they did. And I
know in PAML's case, the "yes" wasn't a rubberstamp.

Yeah, but Topica's works. And Topica isn't hiding behind false
addresses or any of the other things spammers do. If you write
topica, you get a person answering, not a bounce message.
Just because spammers abuse these things by claiming to have what
they do not, you can't dump topica for actually implementing them and
making them available. The spammers make all of those claims because
they SHOULD exist -- so it's not suprising that topica did implement
them...
