Yup. I don't attempt to control or influence off-list activities,
even as they may regard list traffic. Not my business. My specific
interest is in regard to the posting of such "controlled"
information to the list. I'm not in a position to absolutely
prevent it (even in a hand moderated list), so instead I tey and
establish a level of expectations as to how the area would be
handled should it occur.
Again, its all about establishing a character, and thus a level of
social contract and thus expectation.

True, tho this is becoming a turbulent area of law as the
definitions of IP and copyright are having their founding
assumptions redefined/redesigned for digital media. (Heading
off-topic) My suspicion is that the rules of copyright, except in so
far as they relate to original transmissions or release of trade
secrets and other private internal publication only conditions are
perforce going to dissappear utterly over the next 10 years,
actively hastened along that course the more hotly RIAA and MPAA try
and prevent it.

While I realise that I tread on legally shaky ground, I specifically
and actively encourage the full text quoting of reference material
onto the list (or other methods of inserting a copy onto the list
archives or web). The intent, simply, is for archival storage and
reference. It has subsequently turned out that the list archives
holde the sole surviving copies of quite a few critical works for
the respective fields (which I of course then encourage others to
copy off freely).
