In response to calls I made yesterday at 5pm, Lisa Jandovitz called me
early this morning.  She confirmed that the solicitation was on hold and
that fact finding was underway saying that any specific details would have
to come from Becky Burr..... She added that eventually when matters were
settled the solicitaion would be available at the URL below.

My understanding (not from lisa) is that the GAO is now in charge of the
fact finding and is asking plenty of questions of DoC and NTIA.  That GAO
will very quickly see that the procedure they have followed is indefensible
and that the only way that NIST will be allowed to make a new solicitation
is for it to be open source.  While ORSC can of course bid, it is very
likely that others will also be able to bid.

NTIA needs to be far more careful than it has...  I have been talking to
all my legal contacts in DC and the opinion is coming back unanimous: NTIA
has no legally defensible authority to be involved with ICANN or the root
servers.  It is a house of cards that a well timed and well placed lawsuit
will bring crashing down.   All of which makes Mike Roberts and Esther
Dysons behavior even more bizarre.  You would think they would be looking
for friends among us rather than treating us with their Simsean created
legal disdain. Several folk have told me that the only legal authority that
ICANN can ever have is what the internet community is willing to grant it.
