  Good points here Roeland.  ANd We would argue that your point actually
apply nearly as equally with gTLD's as well, hence I assume part of your
reasoning for considering them a moot point given your scenario?  At any
rate, gTLD's that are hosted on additional Roots outside the US would
fall under some of those same trade agreements provisions.

I have a question here. Yes, I know that the ISO is an international org founded by treaty. Therefore it loosely has the backing of the treaty signatories. Also, that the IANA played into this, with RFC 1591. But, as we are seeing, RFC 1591 does not have universal support, among all ccTLDs. Also, RFC1591 does NOT have the force of law that the ISO recommendations do. Therefore the tie-in is weak.

What is to prevent a government from creating its own TLD, inconsistent with RFC1591, i.e. they use the three-letter code?

Would such a TLD not have all of the power of a ccTLD? Thus making most of our arguments wrt gTLDs moot?

Imagine the following sequence.

  • Were I to get the support of the Modavian government,
  • to implement the *.MOLD top level domain,
  • the root servers do not recognize me,
  • I complain to the Modavian gov,
  • they complain to the US State dept. and begin escalating,
  • we setup our own MOLD root-servers and start taking global 3LD registrations,
  • but I make a *lot* of money from SEXXY.MOLD,
  • use Moldavian government capital to begin a world-wide marketing campaign to    popularize the MOLD TLD.
What, in reality, could anyone do about it?

For openers, let's not hear any nonsense about forcing Moldavia into RFC1591 compliance, or excommunicating Moldavia for this activity.
