the thing about those cases is that they set a precedent for others to use.

Ya know, its not just the derelict boats..they are everywhere...every state.
It is, also, those people who think they have a right to just do as
they please.
Some of what they say and do might be legal.  But it is the manner in
which they
go about doing it that leaves a bad taste in land dwellers mouths.
Kinda like a pouty
kid demanding a cookie right now, I want it right now, its my right
sort of thing.
Of course the state deeding over portions of land to the city's does
not help in this matter.
Those city's whose mooring fields are at the edge of the AICW are in a
unique position as they also have to deal with federal rules for the
AICW.  From all the brewha, I will just assume they don't bother to
consult with maritime lawyers regarding the waterway, just some land
dweller who thinks he knows what he is talking about.  example... here
at mymarina the lawyer to the restaurant that owns the marina says
that the use of the bathrooms is a priviledge and that if you get
behind your rent, even one day you can be barred from the
bathhouse...yeah sure... legal, no... discrimmatory you bet.. worth
the hassle to fight it..not in this lifetime.. am outta here as soon
as I can find a cheap motor and get it installed... hel, will row my
way south if I have to... lol...  I like to pick my battles..
I am not behind on my rent, but its the principle of the thing.  It
irritates me..


There is no easy answer to all of this. On either side of the fence.
I do know that one thing that will make the state sit up and take
notice is when thier cities start losing revenue and income and it
makes a  noticeable impact.  By then it might be too late...the baby
has long been tossed in the bathwater.  I truly hope that day does not
come, but I sure as heck see it looming on the horizon.

When it comes to laws......a law passed might be illegal or invalid
technically. As I have said before.... until it is repealed or set
aside by a city council, etc..or a judge.. it is still a law.
The poor clerk in the courthouse has no legal ability to set aside a
law that some moronic city council passed.  The local water cop might,
if he is in a good mood and you have not pissed him off with your
demands that the law is invalid/illegal look the other way.  He is
charged with enforcing the law...until it is not a law.  He cannot
decide what is legal or illegal... but I have seen older cops who have
some experience and some understanding, in that they too are
boaters...just tell you to keep a low profile and walk away. In all of
those instances it helped to have a good working relationship with the
local law.  There are always one or two by the book jerks, but even
the thirsty and lonely and eventually you can snag them with some
converstation and cold soda on a hot day...

When it comes to the keys...its a fragile ecosystem. I would like to
see it last well past my grandkids lifetimes.. I have a type I
msd...because of my attitude I am putting in a pumpout for my sanx to
comply and to be able to visit...I was last at boot key a week or two
before it all changed massively in feb 2005.  If  Charmaine says its
still a good place, not to mention a few others telling me the same...
its definitely a destination for me.

At the moment, once I leave I am giving some serious thought to going
to wilimington for a  yr or so.. both kids are in the east half of the
state now... dtr in Kinston, son still hanging at Bragg - yep he is
back again from his 6th deployment... no cuts, bruises, wounds with
all fingers, toes and sense of humor intact.  Makes sense to move
south, now to hunt up a marina.. and learn up on the nc laws on
boaters..
