FWIW, my current contract has very similar terms.  This delayed my start by 
over a month.  The compromise we worked out was that I gave them a letter 
modifying my conditions of employment such that work done on my own time and
with my own equipment is owned by me.  They countersigned the letter.

Now I'm trying to convince them that it would be a good thing to release the
various tools that I'm writing in $dayjob.
