People often forget that mp3 is not open source and not free. You have to pay royalties to use it.
The problem is that the entity that controls mp3 had not found a way to collect the royalties from each public individual who uses mp3.
Their easiest target is thus the Comapnies. Find a company that sets mp3 as default and collect money from them in the billions if possible.
To avoid the suit companies have come up with their own formats (apple has aac, M$ has wma, sony has theirs as well etc. etc. etc.) But they all play mp3 as a not-default setting.
Novell as a billion dollar company is only protecting itself from being sued.
Linux will always play mp3. But if you are really worried about the legality of mp3 check out ogg
