When you mean "comment", do you mean that the latex file contains
%% This is the code in a comment %% with a \includegraphics{foobar}
It's a \begin{comment} as Juergen pointed out..

It has to be though -- since the LaTeX file compiles nicely.. it's just that LyX decides to convert a figure that has been commented out ... and still produces the correct output... so as Angus, pointed out, a check to ensure that commented figures are not processed would do it..
