Right iPod's are treated like a computer for updates since Apple does not
receive any funds after it is purchased other than buy app's music or movies.
So they charge for the OS update.
The first tab on your settings will setup how you have the check for software
updates set up. On the tab you in see the date that iTunes last checked for a
software update.

Another tip my NetNewsWire app on my iPhone started crashing every time I
started it up.
Now this is a bad thing as I use NetNewsWire to check all 1500 rss feeds I read
everyday all day long. So I held down my finger on the icon to get the icons
in dancing mode.:)
I then tapped on the X and deleted the app. I then went in on the app store on
the iPhone and download the app again and set it up again by logging into my
account.
App is now working much better. NetNewsWire is going to be using Google News to
sync in the future I hope it helps the app as the sync issue borked the app.

It couldn't be something as simple as that, could it? I mean, I do
update my computer software routinely, my iPod certainly would also update,
wouldn't it?
Thanks Ed. I must have been updating my computer without having my iPod
attached. It's now fixed. (Didn't know I had to BUY it!)
