Dot Mac Gets Dot Legal

Dotting the i in iTools.

reports that at least one UK iTools user is taking the .Mac issue to court.

The story says that this is a small claims court action. It is based upon Apple''s 
advertising of iTools'' features with the OS X software box. iTools was listed as an 
internet feature.

As far as IGM is aware, there have been no other mooted court actions in the US or 
elsewhere, despite the plethora of protests following the .Mac announcements at MWNY.

Apple''s .Mac terms and conditions do not necessarily mean that the service is 
available as a regular US service outside the United States. It is unclear whether the 
case will have standing in a British or any other court.

Analysis: Like many non-US residents, I had to lie to Apple and claim my postcode was 
somewhere in Little Rock. Come to that, I was using OS 8.1 on a Quadra at the time and 
simply used a newer version of the AppleShare extension to log into my iDisk. Apple 
didn''t seem to mind.

But I also recall upon purchasing OS 9 (my "internet co-pilot") that my iTools .mac 
address was free "for life". I felt entitled to it then. I paid for it.

No longer.

On a technicality, iTools no longer exists anymore. Apple didn''t say "we''ll give you 
.mac for life", did they? But if I could be bothered to find my OS 9 box, I''m sure it 
says somewhere that you get the email address. And, after all, Steve said so (live) at 
some point. So it must be true.

Isn''t it?

Whether users get angry enough to launch a class action suit in the US is another 
matter. But there were certainly enough ATI Rage-equipped Mac owners to launch one due 
to their graphics chip''s shortcomings in OS X.
