I can press function twice, release it, speak, and press it once to dictate. I don't believe you need to hold it down by default, and I can't think of a setting to change that.
When this was happening to me, it turned out I had selected the wrong microphone. Go to System Preferences, Dictation and speech, Dictation tab, and ensure the input is set to the microphone you are using (internal by default).
