Because we live in a free society.:)

During the founding of our country a thing called the bill of rights was
included in the constitution. The first 10 amendments are what constitutes the
original bill of rights. These were listed in relative order of importance
with the first amendment representing freedom of expression and speech, the
second is the right to bare arms and represents that right for both the
individual groups. We have guaranties of reasonable search and seizure, the
right to be protected from self incrimination, the right to due process and so
on and so forth. You have no such protection so your governments can make
things like gun ownership impossible. Here we have what the founders would
have called a God given or natural right to these things. (Before the
christians get out of hand, this was a reference to God in the sense of nature
and an over all grand architect of the universe, not a specific invisible man
in the sky). The rights are inherent in nature and can not be taken away by the
government is the proper interpretation.
Later on this document was amended further to add things like being
born on American soil grants you citizenship, we undid a horrible wrong and
granted equal treatment under the law to all people regardless of race as a
result of slavery which is a shameful stain on our history but one we must deal
with head on and was addressed in our constitution, we have an amendment that
was added to prohibit alcohol consumption and one later (the 21st amendment)
that undid prohibition. (You think we would have learned from this instead of
started the damn drug war). The later amendments were more corrections of
wrongs in our history like granting women the right to vote which is another
result of a shameful part of our history but luckily there is a procedure to
update the document and fix these things. To do this the legislature has to
approve the amendment by 2/3rds majority and it needs to be ratified by 3
quarters of the states or 38 I believe in our case today.
Different countries have differing versions of this, some for example
have amendments where racism is unlawful (I like that) or different voting
characteristics and such. Ours were generated as a result of the revolution
originally and freeing our selves from British Rule. Britain would force us to
disarm under certain conditions, tax us with out representation (tea parties
and all) and force us to house British Soldiers (no quarter). Our fore fathers
rejected the idea of a monarchy and our rules of governance all originate from
these early documents, primarily our constitution.
The gun thing gets much more complicated because laws have been past
since that limit certain classes or for example require certain background
checks. When I buy an automatic weapon (machine gun) for example I have to go
through a process with our Bureau of Alcohol, Tobacco and Firearms where a
background check takes place and an official transfer from own owner to another
takes place. With out a lot of special paperwork I can only buy automatic
weapons from pre April of 1986 when additional limitations were placed. Other
what they call destructive devices are similarly regulated like rocket
launchers, grenade launchers and automatic shotguns. However, the basic right
to own most classes of weapons has been upheld time and time again. Even
states and cities attempts to subvert the constitution have been thankfully
overturned in our courts.

This is probably to much of a Civics lesson for this list and certainly
probably of little interest to folks in other countries so I’ll end it here.
If you have any further questions about the way we do things feel free to ping
me off list so we don’t upset the list members.
