One thing I try and remind myself with dealing with Microsoft is that they have 
an extremely limited selection of uneditable boilerplates to work with in terms 
of replying to messages. So I often keep pushing even when they say things like 
“don’t qualify for mitigation” because I know that’s just the boilerplate they 
have to use. If I think there really is a good reason for mitigation (ie, I’m 
not trying to actually get a client to make a change) I write back and explain 
why I think it does qualify (briefly) and ask for mitigation. Sometimes I’ll 
even ask for escalation.

As I understand it, this will require negotiation with the MS legal team. I 
honestly don’t see that happening.
