I'm not a lawyer either, but it's my understanding that as long as you're using the Google Maps published API (as OpenLayers/Fusion/MapGuide is) directly rather than scraping the data, it's a permitted use.
In order to enable Google layers under Fusion you need to sign up for your own API key though, so you'd want to pay attention to the terms: http://code.google.com/apis/maps/terms.html >From a personal perspective, the only one I'd be worried about is certain >layers accidentally obscuring the Google logo and TOS link.
