Solved....
it was in the layer builder
MgByteReader layerDefContent =
BuildLayerDefinitionContent(dataSource, "dbo:cadSecondary_Full", "",
"fd0011", 50, 50, "", "", "1", "fd0011");
was missing dbo:
which returned all elements but did not error ??? wierd wacky but true
