What version? Recursion errors will occur if two layers reference each other or if a layer references itself. From your mapfile snippet that doesn't seem to be the case.
It's a pretty lightly used feature so it's possible there is a flaw in the code. If you use just REQUIRES (so the whole layer would be off unless it passes the test) do you get the same error?
