I can confirm the issue. Not sure what's going on but something's broken in the legend generation. I'll try and sum things up and file a ticket against 5.6. We won't patch back to 5.0 for something like this.
As a workaround you might consider setting a KEYIMAGE in your class definition. Make it the same size as your legend "chips" (usually something like 25x15) and that image will be used instead of creating one dynamically. I tried that here and it seems to work. You should be able to clip a section of a MapServer-created map out for this purpose.
