TOT QUESTION RE: PRIVATE PROPERTY RENTAL Encinitas, being a beach town, has a lot of private property (condo's, beachfront homes, etc), that gets rented out via the local Realtors, et al. for short-term, transient stays. This is allowed by our zoning code. During my tenure, we have never collected TOT from these realtors/agents. My reading of our TOT ordinance is that this is a grey area. The issue is heating up here...and one of the reasons is that, via the internet, agents can attract a lot of business easily. A local condo complex is complaining about how much transient occupancy is occurring in their property and questioning whether they should be paying TOT. Has anyone else out there dealt with this issue? Anyone collecting TOT from local realty offices for this? Thank you for any thoughts you can send my way.
