Dear Doctor Saheb, I have been reading with interest the mail you sent
about the New mental health care bill and the Psychiatrists opposition to it..
What was worrying is that the bill was prepared by a Psychiatrist from Pune who
is expert on these legal issues but still IPS is opposed to it. Your views
about advance directive and other cliches to which many of us agree, why was
IPS was keeping silent all these years of preparation? Now as a carer of a
single child with schizophrrenia I want to ask the IPS some questions. 1 Do
you feel that all Schizophrenics are cured and it does not leave any
disability? 2. If a Schizophrrenic starts taking bath and puts flowers on her
head but does NOT work and not capable of work, will she be called disabled or
cured by IPS? 3. The National Trust controlled by Carers of Austistic and
mentally retarded children give out disability certificates under Local level
committes. Will not similar tyupe of arrangement good for the Mnetally ill
disabled? Why the Psychiatric communkity wants to be part of Dsisabled
community. 4.IDEAS scale and is it not important the way to free from
disability is a person to be able to work and if that person scores 100% in
other parameters but does not work, what is the use for family who have to look
after them life long with a seperate TV and plenty of Pepsi bottles.? 5. A
carer of central government have to go to court to appoint a guardian while in
case of others it is the parents who appoint the guardian? What role IPS plays
in perpetuating this situation? 6. I am puttting the latest census figures on
the disablity figures and the national trust and private Psychiatrists know
thatGovernment works on Statistics and they succeeded while we have to depend
on Psychiatrists and the medical board and IDEAS scale which is interpreted in
favour of ' CURED ' WHICH seems to favour for increasing Mental health budget
and clinical trials as like in Indore. 7. What is take on wandering mentally
ill by IPS? Please go through the statistics carefully and do you feel does
it reflect the correct picture and who is responsible? For me the single
important qustion is AFTER ME WHOM? IPS just do not care for the answer is my

In the 12th Five Year Plan it has been envisagedto establish a National
Institute for Mental Health Rehabilitation (NIMHR). TheGovt. has already
initiated action such as identification of consultancy forestablishment of the
aforesaid Institute at Bhopal. In the 12th Five Year Plan, an amount of Rs
50crore is available for establishment of NIMHR. This information was given by
theMinister of State for Social Justice and Empowerment, Shri Krishan Pal

Heartiest congrats for taking mental health to the lofty peaks of the UN
Sustainable Developmental Goals. I truly appreciate your stand on Policy
advocacy for inclusion under SDGs. However, as you realise unless
accountability of the State is pinned down in terms of implementation, UN's
efforts will prove futile. This is the tragedy we are currently facing in
India.
The rights based MHC bill 2013 is held up in the Ministry of Health , GOI due
to objections raised from mental health professionals especially
psychiatrists. The urgency in passing this Bill is to make the State
accountable for the delivery of MH services in the country. It is so because
this Bill has made mental health a fundamental right; it has also made
accessibility to MH services as a right. This is the only hope for family care
givers because it ensures a package of emergency and crisis services ,
continued and long term care etc.etc. Above all, by bringing Mental health
under NCDs, the GOI has broad based the services from specialist driven to
system's driven service so that the shortage of qualified professionals can be
tackled somewhat besides de stigmatising mental health.
I therefore request your support for legal advocacy in addition to policy
advocacy to establish true partnership with families ( that obviously includes
user patients). Your present office as Sec.General of WPA is most ideally
equipped for carrying the mission of legal advocacy with the Govt of India /
MoHFW. The Budget session is scheduled to end by 23rd and hence plesae hasten
your initiative.
