The, I believe, unique language in Article 4(2) the 1990 U.S.-China Civil Air Transport Agreement that DOT relies upon to impose the ban on overflights reads: *The operation of the agreed services by the designated airline(s) on routes over third countries shall be conducted on routes available to the airlines of both Parties, unless otherwise agreed.* Such language is not included in U.S. Open Agreements with other countries. Rather, the "grant of rights" article provides that flights may be operated *without directional or geographic limitation. * -- *John R.
